Terms of Service

These terms were drafted as a starting point and are still being finalized. They are pending review by our attorney, and this note will be removed once that review is complete.
These Terms of Service cover your use of the Broad Street Exchange, LLC website, shop, memberships, BSE Rewards program, and trade-in service. Please read them before buying or joining.
Acceptance of these terms
By visiting this site, creating an account, joining a membership, or placing an order, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site. These terms apply to every visitor, member, and customer of Broad Street Exchange, LLC.
Accounts and memberships
There are two membership levels: Free Play, which is free, and VIP. You must provide accurate information when you create an account, keep your password secure, and you are responsible for activity under your account. VIP membership is billed at the price and interval shown at signup and renews automatically until you cancel. You can cancel at any time from your account; cancellation stops future billing and VIP benefits end at the close of the paid period. We do not prorate partial periods except where the law requires it.
First 50 VIP members get a year free
This offer gives the first 50 signups 12 months of VIP membership at no cost, running through 2027. The offer is limited to the first 50 accounts, is personal and non-transferable, cannot be sold, gifted, or combined with other membership promotions, and is limited to one per person and household. When the 12 months end, membership continues only if you choose to subscribe. We may end the offer early if the limit is reached or if it is being abused.
BSE Rewards and Broad Street Points
Broad Street Points are earned on qualifying purchases and eligible program activity, and are redeemed as one-time discounts toward orders at the rates shown on the Rewards page. Points have no cash value, cannot be sold or transferred, and cannot be exchanged for cash. Points expire one year after they are earned; we email a reminder before they expire. Points applied to a checkout are held until the order is completed, and are returned to your balance if the order is not completed. We may modify, pause, or discontinue the rewards program, or change earning and redemption rates, with notice to members. Points are reversed on refunded or cancelled orders, and are forfeited if an account is terminated for violating these terms.
Product condition and authenticity
Everything we sell is pre-owned or collectible unless a listing clearly says otherwise. We clean, test, and grade each piece and describe its condition to the best of our ability, including what is and is not included. Items are sold in the condition described at the time of listing, with the normal wear you would expect from retro media and hardware. Photos are of the actual item where shown. We do not sell knowingly counterfeit or reproduction items, and any reproduction is labeled as such. If something turns out not to be as described, our returns process covers it.
Ordering, payment, and shipping
Orders are offers to buy, and are accepted when we confirm and ship them. Checkout is processed through Shopify; payment methods, currency, and card handling are governed by Shopify's checkout, and we never see your full card number. Prices, availability, and stock counts can change, and inventory is one-of-a-kind, so listings can sell out while items sit in your cart. If we cannot fulfill an order, or a listing carried a pricing or description error, we may cancel it and refund you in full. 14-day returns
You may request a return within 14 days of delivery. If a piece does not match the condition described on its listing, we cover return shipping and refund you in full. Change-of-mind returns must come back in the same condition they shipped in, with all included items, and return shipping is yours to cover. Sealed and graded items, digital gift cards, redeemed store credit, and personalized items are final sale. Trade-ins and selling your collection
Any quote we give for a collection is an estimate based on the information and photos you provide, and is not binding until we physically inspect the items. On inspection we may revise or withdraw an offer, and we reserve the right to decline any item or collection for any lawful reason, including condition, authenticity concerns, or unclear ownership. By submitting items you confirm you are their lawful owner and have the right to sell them. Offers are valid for the window stated in the offer, and payment or store credit is issued once you accept after inspection.
Prohibited conduct
You may not use the site for fraud, use stolen payment methods, or submit items you do not own. You may not abuse the rewards or referral program through duplicate accounts, self-referrals, fake orders, or purchase-and-refund cycles intended to farm points. You may not sell, buy, share, or transfer accounts or memberships, scrape or overload the site, attempt unauthorized access, or resell inventory in a way that breaks purchase limits set on a drop. We may cancel orders, void points, and suspend or terminate accounts for these activities.
Intellectual property
The Broad Street Exchange name, crest, logos, design, site code, written copy, and our own product photography belong to Broad Street Exchange, LLC and are protected by copyright and trademark law. You may not copy, republish, or use them commercially without our written permission. Console names, game titles, box art, and other marks shown in listings belong to their respective owners and are used only to identify the items we sell.
Limitation of liability
The site and services are provided on an "as is" and "as available" basis, without warranties of any kind beyond those that cannot be disclaimed by law. To the fullest extent permitted by law, Broad Street Exchange, LLC and its owners and staff are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or collecting value, arising from your use of the site or the items you buy. Our total liability for any claim will not exceed the amount you paid us for the order the claim relates to.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising from these terms, the site, or a purchase will be brought in the state or federal courts located in New Jersey, and you agree to that venue.
Changes to these terms
We may update these terms as the business grows. When we do, we will revise the date at the top of this page and, for material changes, notify members by email or with a notice on the site. Changes apply going forward; orders already placed are governed by the terms in effect at the time. Continued use of the site after changes take effect means you accept the updated terms.
